Answer
Following the transfer of responsibility for the majority of planning functions to local councils in April 2015, it is a matter for the local council to determine whether the quarry is operating within its planning permission.
It should be noted that the local council has powers to control nuisance vibrations (from blasting), noise emissions and dust from quarries under the Clean Neighbourhoods and Environment Act 2011. These powers are separate from the council’s powers under planning legislation.
